RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL
CONSENT AGREEMENT ("AGREEMENT")


IN CONSIDERATION of being permitted to participate in any way in ASA certified Programs (“Activity") I, for myself, my
personal representatives, assigns, heirs, and next of kin:


1. ACKNOWLEDGE, agree, and represent that I understand the nature of Sailing Activities and that I am qualified, in good
health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe
conditions to be unsafe, I will immediately discontinue further participation in the Activity.

2. FULLY UNDERSTAND that: (a) SAILING ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY,
INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by
my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity
takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL
AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.

3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE ASA, ASA Certified Instructors, their respective
administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers,
and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the
"RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR
ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE,
INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF
LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of
the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses,
attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.


I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP
SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR
ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY
TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO
BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. THIS WAIVER AND
RELEASE WILL BE INTERPRETED AND ENFORCED PURSUANT TO CALIFORNIA LAW.

AND I, THE MINOR'S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF SAILING ACTIVITIES AND
THE MINOR'S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN
PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT
NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE'S FROM ALL

REGISTRATION TERMS and CONDITIONS:


REFUND POLICY:  Tuition is NON-REFUNDABLE but is TRANSFERABLE
Rain Dates and Make-Up Classes (at no charge) will be provided in the event of class cancellations due to unsafe or otherwise un-sailable weather conditions.


CANCELLATION POLICY:
Cancellations and Rescheduling of any class must be made 45 days prior to a class start date in order to receive a tuition refund. Cancellations made less than 45 days prior to class will not receive a refund and cannot be rescheduled. Cancellation of "Make-Up" classes (for any reason) will be subject to a $275.00 rescheduling service charge. 

BAD WEATHER MAKE-UP CLASSES:: (NO REFUNDS WILL BE GIVEN DUE TO BAD WEATHER)

Sailing is an outdoor activity as are Major League Baseball Games and Outdoor Concerts. If a student is unable to start or complete a course due to unfavorable weather conditions, "Make-Up" classes will be offered at no charge in lieu of REFUNDS.The student will be personally responsible for scheduling and confirming their own "Make-Up" class date. The Carolina Mainsheet School of Sailing CANCELLATION POLICY applies to all Make-Up class schedule dates. 

                                                                                        
ALCOHOL, DRUGS, TOBACCO and FIRE ARMS POLICY:

At Carolina Mainsheet School of Sailing, safety is our highest of all concerns. Our School maintains an ALCOHOL, DRUG, TOBACCO and FIRE ARMS Free Environment.

1. The products listed herein, but not limited to, are not permitted on school premises including docks, marina facilities, classrooms or boats and are not to be consumed, used in any way or in the possession of students during class times, including live-aboard hours.
2. Under the authority of their USCG Licensed Captain, students who violate this policy may be considered a threat to the safety of themselves, other crew-members or school facilities and may be dismissed from the class .

3. For students who have been dismissed from a class, the following will apply:
         A: They will not be permitted to continue with their course work.
         B: They will be asked to disembark the teaching vessel and/or completely vacate the school premises.

         C: They will forfeit any remaining portion of their tuition without refund.

         D: They will not be permitted to reschedule their class.


DRESS CODE and CODE of CONDUCT:

Carolina Mainsheet School of Sailing maintains a Dress Code and Code of Conduct. They are based solely upon safety. How a sailor dresses for weather and sea conditions and how they conduct themselves as a crew-member (i.e., fellow student) can result in serious health and safety consequences for themselves and/or their fellow crew-members.


In advance of your class, we will make suggestions and offer advice about what to bring and how to dress. It is expected of the student to heed our advice. But largely it comes down to common sense decision-making. Remember this: Whatever the weather condition surrounding you while standing in your driveway at home, those conditions will be far worse and have a far greater effect upon you out on the open water. It's always best to plan for the worst.


It is further expected of our students that they conduct themselves with civility and respect for others, including their Captain, at all times and under all circumstances.
